DOJ opens criminal probe into Supreme Court leak that exposed Roe draft; Pirro's office leads

FACTS

The Justice Department has opened a criminal investigation into the 2022 Supreme Court leak that exposed the draft opinion overturning Roe v. Wade, Fox News reported Thursday, years after Chief Justice John Roberts' internal inquiry failed to name a culprit.

U.S. Attorney Jeanine Pirro's Washington office is leading the probe, multiple sources briefed on the matter told Fox News. The investigation has been underway for at least a year, sources said, and grand jury subpoenas have been issued. The New York Times first reported the inquiry; Politico published the draft on May 2, 2022.

DOJ and the U.S. Attorney's Office declined to comment. Justice Samuel Alito told Fox News last month he has an opinion on who was responsible but that the available evidence is not strong enough for him or the Court to identify that person publicly.
