DOJ ramps up criminal probe into 2022 Supreme Court Dobbs leak

FACTS

The Justice Department is pursuing a criminal investigation into who leaked the Supreme Court's draft Dobbs opinion to Politico in May 2022 — a breach that overturned Roe v. Wade two months early and triggered death threats against the justices in the majority.

U.S. Attorney for D.C. Jeanine Pirro's office is overseeing the inquiry. Prosecutors have issued grand jury subpoenas for testimony and sought information from people who worked at the Court at the time of the leak. A DOJ spokesperson declined to confirm or deny an ongoing investigation.

Chief Justice John Roberts ordered an internal marshal's inquiry after the leak; that review ended in January 2023 without identifying a culprit. Justice Samuel Alito has said he has an opinion about who was responsible but that the evidence is not strong enough to name them. President Trump has said the leaker "should be found."
