Judge overrides Mamdani: NYC must hand ICE names from a Bronx migrant shelter

FACTS

A federal judge has overridden New York City Mayor Zohran Mamdani's objections and ordered his administration to comply with an Immigration and Customs Enforcement subpoena for information on residents of a city homeless shelter in the Bronx, the Washington Examiner reported.

U.S. District Judge Lewis Kaplan, a Clinton appointee, ruled Friday that the city must provide the names and birth dates of men staying at the shelter so ICE can determine whether they are in the country illegally and subject to deportation. The federal government agreed to a special master who will identify only residents with certain serious criminal histories and pass those names to the agency.

"The City has not shown that producing this list would be unduly burdensome," Kaplan wrote in a 12-page order. "Under the applicable case law, the Court therefore has no choice but to compel the subpoena's enforcement." He gave both sides two weeks to propose an order appointing the special master.

The city had argued the subpoena would "circumvent and undermine" its sanctuary laws. A Mamdani spokesperson said the administration is considering an appeal, and New York Attorney General Letitia James told Politico her office is reviewing that possibility.
