Days after the Democratic wave, Sotomayor says she hopes the Supreme Court overturns its Trump immunity ruling

FACTS

Supreme Court Justice Sonia Sotomayor said she hopes the court will overturn its 2024 presidential immunity decision in her lifetime, the Washington Examiner reported Sunday.

"I dissent a lot," Sotomayor said Saturday at an event at the George Washington Presidential Library in Virginia. "I'm hoping that the court will take back some of the crazy things that it's done. I'm only joking ... maybe not."

"There's some opinions that I hope in my lifetime will get overturned. The immunity case is one of them," she said.

In that July 2024 ruling, the court decided 6-3 that a president has no immunity for unofficial acts but does have immunity for official acts. Sotomayor, Elena Kagan and Ketanji Brown Jackson dissented. At the time, Sotomayor wrote that the majority gave then-candidate Donald Trump "all the immunity he asked for and more."

Speaking days after the midterms gave Democrats control of the House and Senate, Sotomayor also said the rule of law is in a "rough patch" and that the country is at a "critical point in our history."
